Markel Insurance Company
Markel underwrites the Accident and Liability programs that make up an important part of the benefit of membership in the NFHS. Markel is rated “A” (Excellent) by A.M. Best’s rating service. Markel has a strong history and reputation in such specialty areas as Sports, Recreation and School insurance products.
Insurance Program General Description
What insurance benefits does my NFHS Speech,
Debate and Theatre Association Membership provide?
Your membership in one of the NFHS’s Professional Associations
includes a package of insurance providing you with general
liability, accident medical and accidental death and dismemberment
insurance. These coverages are automatically provided to you as part
of your membership dues. There is no additional fee for this
insurance program.
Who is covered?
- All speech, debate and theatre teachers and
directors who join the NFHS Speech, Debate and Theatre
Association are eligible for the NFHS membership
insurance benefit and are covered for activities as
shown below.
- State and local associations that have 100%
membership in the NFHS Speech, Debate and Theatre
Association are included as additional insureds under
the general liability policy.
What Activities are Covered?
The NFHS Speech, Debate and Theatre
Association liability insurance covers member speech educators when
they are performing that part of their duties that is
"extra-curricular", which could be before, during or after the
school day. It does not cover the member when they are fulfilling
that part of their duties that is curricular (during the regular
school day). The intent of the coverage is such that members are
covered for all extra-curricular activities from the time that
students are instructed to arrive for the activity until the time
the students leave the function. Necessary school sponsored group
travel to and from the function (normally bus travel) would be
covered, but travel on their own from their place of residence to
school or to the site of the function and the return trip from
school or the site of the function to their place of residence would
not be covered.
Members of the NFHS Speech,
Debate and Theatre Association are covered for the
following activities under the insurance plan:
- Members are covered during extra-curricular
speech, debate and theatre event s whether such
event occurs before, during or after the school
day.
- Members are covered while judging at a
speech, debate and drama contest or festival
whether such event occurs before, during or
after the school day.
- Members are covered during conducting a
clinic with an interscholastic speech, debate
and drama group or individual, whether such
clinic occurs before, during or after the school
day.
- Members are covered while attending a
national, state or local speech, debate or
theatre association conference or meeting
before, during or after the school day.
- Members are covered while serving as a
speech, debate or theatre contest or festival
manager before during or after the school day.
- Members are covered while teaching groups or
individuals both before and after the school day
(as an extra-curricular activity) but not during
the school day (as a curricular activity).
- Members are not
covered while performing their regular teaching
duties during the school day.
- Group Travel: Members are covered during
school sponsored travel as a group to and from
covered activities (normally by bus or van).
However, individual travel from the member's
place of residence to the school or to the site
of the function, or the return trip from school
or site of the function to their place of
residence is not
covered by the policy.
What is the Coverage Territory?
The general liability and accident policies protect the
member teachers while in the United States, its territories
and possessions. Coverage also applies while the coach,
director or judge is performing their duties as such,
temporarily outside the US.
When is the insurance Plan effective?
The general liability and
accident policies cover member coaches, directors and judges
during their Individual Membership period. The membership
period is one calendar year from the date the properly
completed application and appropriate fees are received by
the NFHS.

What is Covered?
The general liability policy provides coverage for
claims or lawsuits that arise out of
bodily injury or
property
damage during a covered activity. The policy also provides coverage
for claims arising out of participant’s legal liability, personal
injury, advertising injury and products or completed operations
liability. Defense costs are included in the limit of coverage
provided. This coverage is excess over any other valid and
collectible insurance.
Notable Exclusions:
The standard commercial general liability
exclusions apply (such as War, Nuclear Energy, Absolute Pollution,
Asbestos); in addition, the policy excludes coverage for abuse and
molestation, the use of fireworks, and no liability coverage is
provided to any member while driving any auto.

Many members
of the Speech Debate and Theater Association are required to show proof
of liability insurance in order to perform their duties. By

What is Covered?
Members are insured for
accidental injuries they
incur during covered coaching or instructing activities. The policy
also provides coverage for direct travel to and from covered
activities. This policy is
excess over any other valid and
collectible insurance, employee benefit program, employee welfare
program or governmental benefit or welfare plan. The policy pays the
reasonable and customary medical, dental, hospital and nursing
expenses incurred as a result of a covered accident.
Notable Exclusions: No benefits will be paid for a loss caused by or
resulting in the following:
- Service or treatment rendered by a doctor or any other person
employed or retained by the Policyholder;
- Eyeglasses or contact lenses or prescriptions;
- Hernia unless it results from a covered injury;
- Injury covered by worker's compensation or similar legislation, or
automobile no-fault law;
- Any sickness or bodily sickness;
- Air travel, except on a commercial aircraft operating on a regularly
scheduled passenger route; or
- Injury received as a consequence of the injured party's intoxication
(alcohol or drug related), as defined by the laws of the
jurisdiction where the loss occurred.
